Welcome to Elite Luxe Activewear (“Elite Luxe,” “we,” “us,” or “our”). By accessing or using eliteluxeactivewear.com (the “Site”) and/or purchasing from us, you agree to these Terms & Conditions (the “Terms”). If you do not agree, please do not use the Site.
1) Eligibility & Account Responsibilities
You must be at least 18 years old (or the age of majority in your area) to make purchases on our Site. If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activities under your account.
2) Products, Descriptions & Availability
We work to display products as accurately as possible. However, colors and appearance may vary by screen/device, lighting, and manufacturing. Product availability may change at any time, and we may limit quantities, discontinue items, or update product details without notice.
3) Pricing, Promotions & Errors
All prices are shown in the currency displayed at checkout. We reserve the right to change prices at any time. Promotions and discount codes are subject to change and may have exclusions.
If a product is listed with an incorrect price or incorrect information due to an error, we reserve the right to correct the error and cancel any affected orders (even after an order is submitted). If your order is canceled after payment is captured, we will issue a refund to the original payment method.
4) Orders & Payment
By placing an order, you represent that:
- The payment information provided is accurate and authorized, and
- You are authorized to use the payment method.
We may refuse, cancel, or limit orders at our discretion, including for suspected fraud, resale concerns, policy abuse, or unusual activity.
5) Shipping & Delivery
Processing times and shipping estimates are listed in our Shipping Policy. Delivery dates are estimates and are not guaranteed. Once an order is shipped, carrier delays, weather, incorrect addresses, and other external issues may impact delivery.
Customers are responsible for providing an accurate shipping address. If an order is returned to us due to an incorrect or incomplete address, additional shipping charges may apply to reship the order.
6) Returns, Store Credit, Exchanges & Refunds (5-Day Policy)
Your purchase is subject to our Refund & Returns Policy, including our 5-day return request window and item condition requirements. Items returned with signs of wear (including deodorant marks, makeup stains, odors, pet hair/lint buildup), missing tags, or outside the return window may be rejected.
Sale/clearance items and gift cards may be final sale as described in our policies.
7) Chargebacks & Payment Disputes
If you have an issue with an order, please contact us first at eliteluxeactivewear@gmail.com so we can help resolve it. Submitting a chargeback for an eligible issue without contacting us may delay resolution and can result in account restrictions.
8) Intellectual Property
All content on this Site—including logos, branding, product photos, graphics, text, and design—is owned by Elite Luxe Activewear or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or exploit any content without written permission.
9) Acceptable Use
You agree not to misuse the Site, including by attempting to disrupt the Site, access systems without authorization, scrape content, transmit malicious code, or engage in fraudulent activity.
10) Disclaimer of Warranties
The Site and products are provided “as is” and “as available,” to the fullest extent permitted by law. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components.
11) Limitation of Liability
To the fullest extent permitted by law, Elite Luxe Activewear will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchases, including carrier delays, lost profits, or business interruption. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.
12) Indemnification
You agree to indemnify and hold Elite Luxe Activewear harmless from claims, damages, liabilities, and expenses (including attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or infringement of any rights of another.

Your use of the Site is also governed by our Privacy Policy.
14) Governing Law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles.
